What belongs in a civil claim?

Title 9 covers recognized losses involving contracts, rent, wages, debt, deposits, property, refunds, business dealings, and other listed claims (§ 9.1.1). It does not allow claims for hurt feelings, a bad bargain freely made, grades, school consequences, matters outside Mamonovia, or claims against the Judge (§ 9.1.2).

Prepare your filing

  • The plaintiff’s and defendant’s names.
  • What happened, in chronological order.
  • The section, contract, or agreement you rely on.
  • The amount or other relief requested.
  • A list of documents and witnesses.
  • Copies of any relevant contract, agreement, deed, or notice.

Required by § 9.2.1. Appendix A lists a $10 Civil Claim filing fee, paid to the Treasury when the Clerk accepts the filing. The losing party reimburses the winner’s filing fee as part of the judgment.

Timing and next steps

  1. File within one grading period of the breach or loss, or discovery if it was hidden (§ 9.2.5).
  2. The Clerk serves the defendant on the same or next class day (§ 9.2.2).
  3. The defendant’s Answer is due by the next Court Day after service (§ 9.2.3).
  4. Before a civil trial, the parties attend mediation on the next ClassBank Day after the Answer, for no more than five minutes (§ 9.3.1).
  5. If there is no settlement, the Clerk schedules the next Court Day (§ 9.3.4).

Get ready for court

Either party may appear alone or with a licensed attorney. A Public Defender is available to a defendant on request (§ 9.4.4). The plaintiff must prove each part of the claim by a preponderance of the evidence (§ 9.4.3).
